US Congress to repeal 22nd Amendment, pave way for Obama's 3rd term

A United States congressman has introduced a bill that would repeal the 22nd Amendment, which currently limits the president to serving only two terms as commander-in-chief.

Should the bill become a law, it could allow President Barack Obama to run for reelection yet again in 2016.

The bill, H.J. Res. 15, offers “an amendment to the Constitution of the United States to repeal the twenty-second article of amendment, thereby removing the limitation on the number of terms an individual may serve as President.”

New York Democratic Rep. Jose Serrano reintroduced the measure on January 4, after it did not make it to a floor vote in January 2011, the Daily Caller reports. Serrano has attempted to repeal the amendment for decades and proposed similar bills in 1997, 1999, 2001, 2003, 2005, and 2007.

Rep. Serrano’s initiatives are not dependent on any particular party, since he has tried to get the measure passed under the presidencies of both Democrats and Republicans. But if the bill makes it to the floor for a vote this year, President Obama, a Democrat, might have a chance at a third term in the White House, which would make him the first president to possibly seek a third term since Franklin Roosevelt.

Even though a repeal has not made it far in Congress, there have been several attempts at bringing it to the floor, which have garnered support from past presidents and prominent legislators. Rep. Steny Hoyer (D-Md.) repeatedly proposed repealing the 22nd Amendment while both Bill Clinton and George W. Bush were in office, and Senate Minority Leader Mitch McConnell tried to repeal it in 1995. In 1989, Senate Majority Leader Harry Reid (D-Nev.) introduced a similar resolution.

Former President Ronald Reagan told Barbara Walters in a 1986 interview that the 22nd Amendment “was a mistake,” while former President Bill Clinton has always believed in the option for a president to seek reelection at a later time – even if he has already served twice.

“Shouldn’t a president be able to take two terms, take time off and run again?” Clinton said in an MSNBC interview in November. “I’ve always thought that should be the rule. I think as a practical matter, you couldn’t apply this to anyone who has already served, but going forward, I personally believe that should be the rule.”

Repealing the 22nd Amendment has been supported by both Democrats and Republicans, but has never garnered enough votes to go into effect.

Congress passed the 22nd Amendment on March 21, 1947. It was ratified by 41 states and rejected by only two. It limits each president to two terms, but did not apply to the sitting president, former President Harry Truman, who withdrew as a candidate for re-election in 1952.

    Repealing the POTUS term limit is a truly idiotic idea, because if a president can’t accomplish what he intends to do in 8 years, chances are he will never be able to do it. Congress still makes the laws, not the president.

    Every re-elected president has had 8 terms of Congress to convince the people’s representatives to enact his ideas, and if they are rejecting the president’s ideas 8 years in succession, then the president should find other employment.

    Now if a president is so dumb that he wants to be president for life, he deserves to be impeached.

    Congress does not have the power to repeal and amendment. They can propose it, but it must then be ratified by 3/4’s of the states. That typically takes years and Obama will die of old age first.

But no constitution, even the most brilliantly written one, can save a society from corruption, ignorance, disorder, and poverty. What is crucial in determining the level of prosperity, education, orderliness and culture in a society is not its constitution, but rather the character, quality and values of its people, and especially its leaders. For many years now the US Supreme Court, reflecting the interests, agenda and ideology of those who hold power, has “interpreted” the Constitution to validate the programs and policies it likes — in blatant violation of the document’s original spirit and plain meaning. Few Americans realize just how undemocratic the “original” Constitution was, and how distrustful its authors were of power by “the people.” While the US Constitution is brilliantly conceived, it has major defects. It failed in the most serious crisis in US history: the Civil War. Now it’s little more than an instrument of those in power to provide a veneer of legality in furthering their interests and agenda.

    I assume that what failed in the civil war was President Lincoln rather than the constitution.

    Entry into the Union was voluntary, so exit from the Union should have been voluntary. Lincoln had no right to demand the Confederate states to remain part of the Union. If Russia had made a similar demand of the Baltic states, the U.N. membership would have condemned it. Lincoln had no legal basis to prevent secession of the states. Article 10 of the constitution reserved all unlisted powers to the states and the people, which would include the power to leave the Union because there was no mention of secession in the constitution.

    A very small federal government would limit opportunities for corruption, and have less affect on the states and the citizens.

    Part of America’s deterioration is the ability of government to borrow fantastically large amounts of money, with the borrowers (Congress) determining their own debt limit. And part of the problem is the tax code that gives the government a percentage of income rather than a specific sum divided equally among the states.

    My view is that the states created the federal government, the constitution was written to limit the size of the federal government, so the 16th amendment, the income tax amendment, should refer solely to the states who should be funding the federal government, not the citizens.

    Nothing in the 16th amendment specifies WHO is to pay the tax. As the states formed that government, it would be the states responsibility to fund their creation.

    Assessing the states a share of the cost of federal government would require a much smaller federal government exactly as contemplated by the writers of the constitution.

    America needs decentralization of government, and a transfer of power back to the states, and that will slowly happen as the fed’s excesses are rejected by state legislatures.
